1 Applicability
1.1 These General Terms and Conditions (hereinafter: "Terms") apply exclusively to all offers, orders, and agreements of VAN DAM, to the exclusion of any other general terms and conditions. These Terms will be provided to you upon request. 1.2 Acceptance of an offer or placing an order implies acceptance of these Terms. 1.3 Deviations from these Terms can only be made in writing, in which case the other provisions remain unaffected. 1.4 All rights and claims stipulated in these Terms and any subsequent agreements for the benefit of VAN DAM are also stipulated for the benefit of intermediaries and other third parties engaged by VAN DAM. The agreement is only concluded upon acceptance of your order by VAN DAM. VAN DAM reserves the right to refuse orders or impose certain conditions on delivery, unless expressly agreed otherwise. If an order is not accepted, VAN DAM will notify you within two (2) working days after receiving the order.
2 Prices/Offers
2.1 All offers from VAN DAM are non-binding, and VAN DAM expressly reserves the right to change prices, especially if necessary due to legal regulations. 2.2 All prices are in euros, inclusive of VAT, and exclusive of shipping costs and options. 2.3 If an item is incorrectly priced due to a human error, vandamluxury.com reserves the right to cancel the order.
3 Returns
3.1 If the item you ordered is not quite what you expected, you can return it within 14 days, properly stamped, to VAN DAM at Zesstedenweg 127, 1613 JC Grootebroek, Netherlands. Clearly state your order number and address in the return shipment. You can only return items in their original unopened packaging. We will confirm receipt of your return shipment via email and refund the purchase amount within 30 working days. We only accept undamaged and unused items. Return notifications received later than 2 weeks cannot be accepted. Unstamped returns or unnotified returns will also not be accepted. 3.2 You are required to check whether the items delivered to your home meet the order. If not, you can notify VAN DAM via email or WhatsApp within 8 days, explaining why the item does not meet the requirements. VAN DAM will replace the item or refund your payment if it is proven that you do not accept the item for valid reasons. If you are missing an item in your order, you must also report this within 8 days, and VAN DAM will either send the missing item or refund its payment. VAN DAM may request photos, etc., for this purpose. 3.3 In the exceptional case that you receive an item that does not meet the order, VAN DAM reserves the right to replace the item with a new one or refund the amount paid. VAN DAM will bear the return shipping costs in this case. 3.4 If you are returning something, follow these steps: • Package the items to prevent damage. 3.5 Refunds will only be made to the original account used for payment. 3.6 Returns sent back without following the return procedure will not be accepted. 3.7 Packages rejected at the door without prior consultation will be treated as returns because VAN DAM will be charged for the return costs.
4 Payments
4.1 Payments via iDeal, Afterpay, credit card, etc., or bank transfer must be made in advance. Orders can be collected. 4.2 If you order from a country other than the Netherlands and we also need to ship to this country, you can use your right to an intracommunity delivery. You must notify us of this within 24 hours of placing the order, so that we can always process it administratively correctly. Any refunds will be made in the same way as the payment was made.
5 Delivery
The delivery times specified by VAN DAM are indicative only. Exceeding the stated delivery period does not entitle you to compensation. However, if the delivery period exceeds 30 days, you are entitled to cancel the order or terminate the agreement to the extent necessary. Any amounts already collected will be refunded by VAN DAM within 30 days. If the delivery address provided to VAN DAM is incorrect, and the package returns, the shipment will be treated as a return, and return costs will be deducted. If an order is not delivered, we will have our shipping business investigate this for us. Their outcome is binding on us. If something is missing from your order, we will send it if possible. If the purchase amount is lower than the shipping costs, we will refund the purchase amount.
6 Retention of Title
The ownership of delivered products only transfers if you have paid all amounts owed to VAN DAM under any agreement. The risk of the products passes to you upon delivery.
7 Warranty
The warranty is determined by applicable law, under which, in case of defects, the products can be exchanged or repaired. If a product cannot be repaired or if the replacement product is also not possible than VAN DAM will give you a cheque to shop at our website.
